1. Introduction
Welcome to CentralServiceWay ("us," "we," or "our"). The following Terms & Conditions ("Terms") dictate your engagement with our yacht booking services and our website at centralserviceway.site, provided by CentralServiceWay.
By reserving a yacht or utilizing our Service, your compliance with these Terms is mandatory. Should you find any part of these terms unacceptable, you must refrain from using the Service.
2. Service Overview
CentralServiceWay offers first-class yacht charter services, which include, but are not limited to:
- Yacht charters for a day
- Evening yacht excursions
- Business team-building sailings
- Exclusive gatherings
- Long-term yacht charters
We offer our services contingent on their availability and suitable sea conditions. We hold the right to amend or cancel services without prior notice.
3. Booking and Reservations
3.1 Booking Process
For a successful yacht charter booking, you must:
- Confirm you are at minimum 18 years old
- Ensure the information you provide is correct and thorough
- Submit the necessary prepaid deposit as delineated in the booking confirmation
- Consent to these Terms & Conditions
3.2 Confirmation
We will only consider your booking as confirmed after we have received your payment and provided written confirmation. We maintain full authority to decline to provide service to any individual at our discretion.
3.3 Availability
All yacht charters depend on vessel availability and appropriate weather conditions. We will strive to meet your preferred scheduling.
4. Payment Terms
4.1 Pricing
Quoted prices are presented in € and are inclusive of applicable taxes unless otherwise specified. Prices may alter without any notice.
4.2 Payment Schedule
- Deposit: A payment amounting to 50% of the entire charter fee is required at the time of confirming the booking
- Final Payment: The remaining balance is payable 48 hours prior to the departure of the yacht
- Additional fees (where relevant): Payable after the charter's conclusion
4.3 Methods of Payment
We acknowledge a range of payment options including major credit cards, wire transfers, and certified bank cheques. All payment processing is conducted through secure and encrypted systems.
5. Cancellation and Refund Policy
5.1 Customer Cancellations
- If cancelled more than 72 hours before departure: Refund in full minus transaction fees
- If cancelled between 24 to 72 hours before departure: 50% of the charter cost is refundable
- If cancelled less than 24 hours before departure: No refund will be provided
5.2 Weather Cancellations
Under the judgment of our captain, if the weather poses a safety risk, we will suggest to either:
- Allocate an alternative date for the charter without additional charges
- Issue a full refund if rescheduling is not an option
5.3 Mechanical Issues
Should mechanical issues arise with the assigned yacht, we will make an effort to provide a comparable alternative. In the absence of an alternative, we will offer a complete refund.
6. Safety and Conduct
6.1 Safety Requirements
All guests aboard are required to:
- Adhere to instructions from the crew
- Wear prescribed safety equipment as necessary
- Disclose any medical conditions impinging on safety
- Stay within the assigned areas aboard the vessel
6.2 Prohibited Items
The presence of the following items on board is not allowed:
- Glass containers
- Unlawful drugs
- Weapons or firearms
- Excessive non-alcoholic drinks beyond reasonable consumption
- Pets (except for cases granted prior approval)
6.3 Conduct
Passengers are expected to behave in a manner that is respectful. Should any passenger's conduct compromise safety or interfere with another's experience, we hold the right to abandon the charter prematurely without issuing a refund.
7. Liability and Insurance
7.1 Our Liability
We limit our liability to the charter cost paid by you. We are not accountable for:
- Bodily damages incurred due to passenger negligence
- Personal belongings' loss or damage
- Indirect, consequential, or exemplary damages
- Delays caused by elements beyond our control, such as weather
7.2 Insurance
We uphold complete marine insurance for our boats and operations. It is advisable for passengers to have their own personal and travel insurance plans.
7.3 Risk Acknowledgment
By partaking in our charter services, you recognize that maritime activities possess inherent perils, and you shoulder the responsibility for your own welfare and security.
8. Modifications and Itinerary Changes
At our discretion, we reserve the right to revise itineraries, routes, or timetables due to reasons like weather changes, security purposes, or operational needs. We will aim to provide an equivalent alternative experience whenever possible.
9. Force Majeure
We absolve ourselves of any accountability for postponements, cancellations, or changes brought on by events out of our control, including, but not restricted to:
- Severe meteorological conditions
- Natural catastrophes
- Laws issued by the government
- Port shutdowns
- Fleet malfunctions
10. Privacy and Data Protection
Your proprietary data is managed in line with our Privacy Policy. Service use indicates your concurrence to the assemblage and application of data as outlined in our Privacy Policy.
11. Intellectual Property
All digital content on our platform, including but not restricted to text, designs, trademarks, and images, is under protection by intellectual property laws. You must not copy, disseminate, or create derivative works without receiving our explicit consent in writing.
12. Governing Law
The legislation in force within Spain will govern these Terms. Should disputes arise, resolution will occur within the jurisdiction of courts located in Valencia, Spain.
13. Changes to Terms
Alterations to these Terms may be made by us at any given time. Notice of amendments will be relayed via our website, accompanied by an updated date of revision. Continued patronage of our services implies acceptance of the new Terms.
